Terms and Conditions of Use
End-User License Agreement (EULA) of Beauty Assistant

About Us
Appear Digital Ltd mobile applications ("Apps") are published, operated and managed by APPEAR DIGITAL LTD ("we", "us", "our"), a private company limited by shares, incorporated and registered in the United Kingdom with company number 12993935 and registered office at 39 Fairfax Road, London, NW6 4EL. forYou OÜ, a private limited liability company incorporated in Estonia with registration number 16377356, owns the Apps and intellectual property, including the "Beauty Assistant" trademark, licensed to Appear Digital Ltd for publishing, operation and management.
1. Introduction
This End-User License Agreement ("EULA") is a legal agreement between you and Appear Digital Ltd. It governs your acquisition and use of the "Beauty Assistant" mobile application ("App" or "Software").
By installing or using the App, or by tapping an acceptance control in the App, you agree to these Terms. If you do not agree, do not install or use the App.
The App provides beauty, skincare, augmented reality, camera, photo, massage guidance, cosmetic recommendation and AI assistant features for informational and wellness purposes. The App does not provide medical diagnosis, medical treatment, professional dermatology advice or emergency services. For concerning symptoms, pain, infection, persistent inflammation or any medical issue, consult a qualified clinician.
2. License Grant
We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on devices you own or control, subject to these Terms and applicable App Store rules.
You may not copy, modify, reverse engineer, decompile, resell, sublicense, distribute or use the App for unlawful purposes, except where applicable law expressly allows such activity.
3. App Store Terms
If you download the App from the Apple App Store, Apple Inc. is not a party to these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable. Purchases and subscriptions made through the App Store are managed by your Apple ID and are subject to Apple's applicable terms.
4. Subscriptions and Purchases
The App may offer subscriptions or paid features. Payment, renewal, cancellation and refund handling for App Store purchases are controlled by Apple. Paid subscriptions renew automatically unless cancelled in your Apple ID subscription settings before renewal, according to Apple's process.
5. Beauty Assistant and AI Features
Beauty Assistant is an optional AI feature. It can use your voice, live camera frames, recognized text and recent chat context to answer questions, analyze visible beauty and skincare context, guide routines, and recommend cosmetic products.
Beauty Assistant is only started after you grant explicit in-app consent for AI processing. You can stop live sharing at any time by disconnecting Beauty Assistant. You can reset your AI data-processing consent in the Beauty Assistant menu; after reset, Beauty Assistant will ask for consent again before sending audio, camera frames, recognized text or chat context for AI processing.
Beauty Assistant outputs are generated by automated systems and may be inaccurate, incomplete or unsuitable for your circumstances. You are responsible for deciding whether to follow any suggestion. Product recommendations are informational and may be influenced by the product catalog configured for the App.
6. Camera, Microphone and Photos
Camera and microphone access are used only for features you choose to use, such as live camera preview, AR face guides, Beauty Assistant voice conversation, live visual context, massage guidance, and photos you choose to save or share.
Photos are saved to your photo library only when you choose to save them. Photo library access, if requested, is used only for photo features you choose to use.
7. User Content
You retain ownership of content you create or submit through the App, including photos, messages and voice input. You grant us a limited, non-exclusive license to process that content only as needed to provide, secure, maintain and improve the App features you choose to use, subject to the Privacy Policy below and your consent choices.
We do not use your personal content for unrelated marketing, advertising or model training without a separate lawful basis and any required consent.
8. Acceptable Use
You agree not to use the App to violate law, infringe third-party rights, submit content you do not have the right to use, interfere with the App, bypass security, reverse engineer the App except where legally permitted, or use generated content in a way that could harm others.
9. Availability and Changes
The App is provided on an "as is" and "as available" basis. We may update, change, suspend or discontinue features where reasonably necessary for security, legal, operational or product reasons.
10. Limitation of Liability
To the maximum extent permitted by law, Appear Digital Ltd and forYou OÜ are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data or business interruption arising from use of the App. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or terminate access where you materially breach these Terms, where required by law, or where necessary to protect the App or other users.
12. Governing Law
These Terms are governed by English law, except where mandatory consumer protection laws in your country provide otherwise.
Privacy Policy
Effective as of July 10, 2026
This Privacy Policy explains how Appear Digital Ltd processes personal information in connection with Beauty Assistant.
1. Information We Collect
Depending on the features you choose to use, we may process:
- Device and usage information: device model, operating system, app version, language, feature usage, diagnostics, crash and performance data.
- Purchase and subscription information: purchase status, subscription state and related App Store transaction metadata.
- Camera and AR information: live camera preview and AR face tracking data processed on device for visual features.
- Photos you choose to save or share through the App.
- Beauty Assistant data, when you explicitly allow AI processing: voice audio, live camera frames, recognized text, your chat messages, assistant responses, recent chat context and product recommendation context.
- Support correspondence, such as your email address and messages if you contact us.
2. How We Use Information
We use information to:
- provide App features you request;
- run camera, AR, photo, massage guidance, skincare guidance and Beauty Assistant features;
- generate AI answers, live visual feedback and cosmetic recommendations;
- maintain security, prevent abuse, debug errors and improve reliability;
- provide customer support;
- manage purchases and subscriptions;
- comply with legal obligations.
3. Beauty Assistant, Google Gemini and Third-Party AI
Beauty Assistant uses our backend as a proxy to Google Gemini, a third-party AI service provided by Google. We do not call Google Gemini directly from your device.
When you start Beauty Assistant after giving consent, the App may send your voice audio, live camera frames, recognized text and recent chat context to ForYou servers. ForYou servers transmit the necessary data to Google Gemini so the AI can understand your request, use live visual context and respond in real time.
This processing is used only to provide the Beauty Assistant feature you requested, including skin appearance observations, beauty guidance, routine help and cosmetic product recommendations. Beauty Assistant is not a medical device and does not provide medical diagnosis.
We do not store Beauty Assistant chat history for unauthenticated Beauty Assistant sessions. Live audio, live camera frames and live chat context are processed transiently for the active session. Operational logs may be retained for security, debugging and abuse prevention for a limited period.
We do not use your live Beauty Assistant audio, camera frames or chat context to train our own AI models unless we ask for and receive separate explicit consent.
4. Consent and Withdrawal
Before the App sends Beauty Assistant audio, camera frames, recognized text or chat context to ForYou servers or Google Gemini, the App asks for explicit permission.
If you allow AI processing, your choice is saved on the device so you do not have to approve it on every launch. You can stop live sharing at any time by disconnecting Beauty Assistant. You can withdraw the saved permission in the Beauty Assistant menu by selecting the reset AI data consent option. After withdrawal, the App will ask for permission again before using Beauty Assistant.

5. Facial Data and Camera Processing
AR face guides and live camera preview are generally processed on your device. We do not collect or store raw AR face geometry for unauthenticated Beauty Assistant use.
When Beauty Assistant is enabled with your consent, selected camera frames may be transmitted to ForYou servers and Google Gemini as visual context for the live answer. These frames are not stored as a persistent chat history by ForYou for unauthenticated Beauty Assistant sessions.
If a future version adds account-based storage, saved skin analysis, saved photos or cross-app profile features, we will disclose that processing and request any required consent before enabling those features.
6. Sharing With Service Providers
We may share information with service providers that help us operate the App, including:
- Google Gemini: third-party AI processing for Beauty Assistant;
- hosting and infrastructure providers: running ForYou servers and storing operational data;
- Firebase and analytics providers: app diagnostics, analytics and reliability;
- purchase/subscription providers: purchase status and subscription management;
- support and communication providers: responding to your requests.
Service providers may process information only for the purposes described in this Privacy Policy and must protect the data consistently with applicable law and our instructions.
7. Analytics, Advertising and Tracking
The App may use analytics to understand feature performance and improve reliability. If any processing requires Apple's App Tracking Transparency permission, the App will ask through the system prompt before tracking as defined by Apple.
Data gathered from camera, ARKit, facial mapping or photo APIs is not used for third-party advertising or unrelated marketing.
8. Retention and Deletion
We keep personal information only as long as needed for the purposes described above, unless a longer period is required by law, security, dispute resolution or legitimate operational needs.
Beauty Assistant live chat history is not stored by ForYou for unauthenticated Beauty Assistant sessions. Support correspondence and operational logs may be retained for a limited period. If you ask us to delete personal information we store, we will process the request within 30 days unless we must retain certain information by law.
9. International Transfers
Your information may be processed in countries outside your country of residence, including outside the European Economic Area. Where required, we use appropriate safeguards for international transfers.
10. Your Rights
Depending on your location, you may have rights to access, correct, delete, restrict, object to processing, port your data, withdraw consent and lodge a complaint with a supervisory authority.
To exercise rights, contact us at foryou@appear.digital. Withdrawal of consent does not affect processing that occurred before withdrawal.
11. Children's Privacy
The App is not intended for children under 13 or the equivalent minimum age in the relevant jurisdiction. We do not knowingly collect personal information from children without required parental consent. If we learn that we have collected such information, we will delete it as soon as reasonably possible.
12. Security
We use reasonable technical and organizational measures designed to protect personal information from unauthorized access, destruction, use, modification or disclosure. No system is completely secure, and we cannot guarantee absolute security.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated in the App or on our website where appropriate. The effective date above shows when this version took effect.
