Terms and Conditions of Use

End-User License Agreement (EULA) of Beauty Assistant

About Us

Appear Digital Ltd mobile applications ("Apps") are published, operated and managed by APPEAR DIGITAL LTD ("we", "us", "our"), a private company limited by shares, incorporated and registered in the United Kingdom with company number 12993935 and registered office at 39 Fairfax Road, London, NW6 4EL. We can be contacted by email at foryou@appear.digital or by post at the address above.

forYou OÜ, a private limited liability company incorporated in Estonia with registration number 16377356, owns the Apps and intellectual property, including the "Beauty Assistant" trademark, licensed to Appear Digital Ltd for publishing, operation and management.

1. Introduction

This End-User License Agreement ("EULA") is a legal agreement between you and Appear Digital Ltd. It governs your acquisition and use of the "Beauty Assistant" mobile application ("App" or "Software").

By installing or using the App, or by tapping an acceptance control in the App, you agree to these Terms. If you do not agree, do not install or use the App.

The App provides beauty, skincare, augmented reality, camera, photo, massage guidance, cosmetic recommendation and AI assistant features for informational and wellness purposes. The App does not provide medical diagnosis, medical treatment, professional dermatology advice or emergency services. For concerning symptoms, pain, infection, persistent inflammation or any medical issue, consult a qualified clinician.

2. License Grant

We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on devices you own or control, subject to these Terms and applicable App Store rules.

You may not copy, modify, reverse engineer, decompile, resell, sublicense, distribute or use the App for unlawful purposes, except where applicable law expressly allows such activity.

3. App Store Terms

If you download the App from the Apple App Store, Apple Inc. is not a party to these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable. Purchases and subscriptions made through the App Store are managed by your Apple ID and are subject to Apple's applicable terms.

4. Subscriptions and Purchases

The App may offer subscriptions or paid features. Payment, renewal, cancellation and refund handling for App Store purchases are controlled by Apple. Paid subscriptions renew automatically unless cancelled in your Apple ID subscription settings before renewal, according to Apple's process.

5. Beauty Assistant and AI Features

Beauty Assistant is an optional AI feature. It can answer questions, use live visual context, guide beauty routines and recommend cosmetic products. It is separate from the App's non-AI camera, mirror, AR, photo and guidance features.

Before the first AI connection, the App shows a dedicated consent screen that identifies the data, the recipients and the purposes. If you tap "Allow AI Data Sharing", the App may send microphone audio, sampled front-camera frames that may contain your face and surroundings, text you enter or select, and the current AI conversation context to ForYou servers. ForYou servers transmit this content to Google Gemini, an AI service operated by Google LLC, to transcribe and understand requests, interpret live visual context and generate responses. Gemini may use Google Search to answer current-information questions. Responses return to the App through ForYou servers.

No Beauty Assistant audio, camera frame, text or conversation context is transmitted before you provide this consent. Camera and microphone system permissions are separate and do not constitute consent to share data with Google Gemini. You may choose "Not Now" without losing access to non-AI features. Disconnecting Beauty Assistant stops live transmission. Selecting "Withdraw AI Consent and Clear Session" withdraws consent, ends the connection, clears the current local AI transcript and resumable session handle, and requires fresh consent before another AI connection.

Beauty Assistant outputs are generated by automated systems and may be inaccurate, incomplete or unsuitable for your circumstances. You are responsible for deciding whether to follow any suggestion. Product recommendations are informational and may be influenced by the product catalog configured for the App.

6. Camera, Microphone and Photos

Camera and microphone access are used only for features you choose to use, such as live camera preview, AR face guides, Beauty Assistant voice conversation, live visual context, massage guidance, and photos you choose to save or share.

Photos are saved to your photo library only when you choose to save them. Photo library access, if requested, is used only for photo features you choose to use.

7. User Content

You retain ownership of content you create or submit through the App, including photos, messages and voice input. You grant us a limited, non-exclusive license to process that content only as needed to provide, secure, maintain and improve the App features you choose to use, subject to the Privacy Policy below and your consent choices.

We do not use Beauty Assistant content for advertising or to train our own AI models. The production service is configured to use the paid Gemini Developer API, for which Google states that prompts and responses are not used to improve Google products. See the Privacy Policy for processing, retention and provider details.

8. Acceptable Use

You agree not to use the App to violate law, infringe third-party rights, submit content you do not have the right to use, interfere with the App, bypass security, reverse engineer the App except where legally permitted, or use generated content in a way that could harm others.

9. Availability and Changes

The App is provided on an "as is" and "as available" basis. We may update, change, suspend or discontinue features where reasonably necessary for security, legal, operational or product reasons.

10. Limitation of Liability

To the maximum extent permitted by law, Appear Digital Ltd and forYou OÜ are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data or business interruption arising from use of the App. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate access where you materially breach these Terms, where required by law, or where necessary to protect the App or other users.

12. Governing Law

These Terms are governed by English law, except where mandatory consumer protection laws in your country provide otherwise.

Privacy Policy

Effective as of August 5, 2026

This Privacy Policy explains how Appear Digital Ltd, as the operator and data controller, processes personal information in connection with Beauty Assistant. It describes what we collect, how we collect it, why we use it, the parties that receive it, retention and deletion, and your choices.

1. Information We Collect

Depending on the features you choose to use, we may process:

  • Device, app and usage data: device model, operating-system and App version, App language, feature interactions, approximate geography derived from a masked IP address, installation or device identifiers, ARCore API usage, performance data and other diagnostics. We receive this automatically from the App and its Firebase Analytics or ARCore SDKs as described below.
  • On-device camera and AR data: live preview and AR face landmarks used on the device for mirror, overlay and guidance features. Raw face geometry is not sent to ForYou or an AI provider by these non-AI features.
  • Photos: images you choose to capture, save to your photo library or share. Saving occurs only when you select the relevant control.
  • Beauty Assistant content: only after you explicitly consent, microphone audio; sampled front-camera JPEG frames, limited by the App to no more than approximately one frame per second and resized to a maximum dimension of 512 pixels, which may include your face and surroundings; text you type or select, including quick prompts; and the current AI conversation context, including the live transcript, prior requests, AI responses and product-recommendation context.
  • Beauty Assistant technical data: App language or locale, a short random live-session identifier, connection and event timing, stream and frame counts, error information, and a resumable Gemini session handle. The App and ForYou server generate this while providing the live service.
  • Support data: your email address and the content of messages or attachments you choose to send when contacting us.

2. How We Collect Information

We collect information:

  • directly from you when you speak, type, select a prompt, show content to the camera, save a photo or contact support;
  • automatically from your device when you use an enabled feature, such as diagnostics, analytics, live-session events and App configuration;
  • from service providers when they return an AI response, diagnostic event or support response.

Beauty Assistant is opt-in. Merely opening the App, granting iOS camera or microphone permission, or using a non-AI feature does not authorize or initiate transmission to ForYou or Google Gemini.

3. How We Use Information

We use information to:

  • provide App features you request;
  • run camera, AR, photo, massage and skincare guidance on the device;
  • operate Beauty Assistant after consent, including speech transcription, request understanding, live visual interpretation, AI answers and cosmetic-product recommendations;
  • return assistant responses and maintain the current live conversation;
  • maintain security, prevent abuse, investigate errors and improve service reliability;
  • provide customer support;
  • understand aggregated App usage and performance where analytics is enabled; and
  • comply with legal obligations and enforce our terms.

We do not use Beauty Assistant audio, frames, text or conversation context for advertising, cross-app tracking or training our own AI models.

4. Beauty Assistant Data Flow and Explicit Consent

The data flow is:

Beauty Assistant App → ForYou servers → Google Gemini, operated by Google LLC → ForYou servers → Beauty Assistant App

After you tap "Allow AI Data Sharing", the App establishes an encrypted WebSocket connection to ForYou servers and may send the Beauty Assistant content listed in Section 1. ForYou servers proxy the content to the Gemini Developer API operated by Google LLC. Gemini processes it to transcribe and understand your request, interpret sampled camera context, maintain the active conversation and generate audio or text responses. Gemini may invoke Google Search for current-information questions. The response returns to the App through ForYou servers.

No Beauty Assistant audio, frame, text or conversation context is sent before the dedicated consent screen is accepted. We request consent again when the disclosure version changes. Declining consent does not restrict non-AI features. iOS camera and microphone permissions control access to device sensors but are not consent to disclose data to Google.

Disconnecting Beauty Assistant stops new transmission. You can select "Withdraw AI Consent and Clear Session" in the Beauty Assistant menu at any time; this disconnects the service, removes the saved consent, clears the local live transcript and resumable session handle, and requires new consent before reconnecting.

5. Google Gemini Processing and Protection

The production Beauty Assistant uses the Gemini Developer API Paid Services, not Vertex AI. The Gemini API key used for the App Review and production service is associated with a Google Cloud project that has active Cloud Billing.

Google states in the Gemini API Additional Terms that, for Paid Services, it does not use prompts or responses to improve its products and processes them under the applicable Google data-processing terms. Google states that content logged for abuse monitoring is retained for up to 55 days. When Gemini uses Grounding with Google Search, Google states that prompts, contextual information and generated output are retained for 30 days for grounded-result and search-suggestion processing. Gemini may also use isolated in-memory caching for up to 24 hours and session-resumption storage as described in its Gemini Developer API data-retention documentation.

Google LLC acts as our service provider for this processing. We require providers receiving personal information to apply the same or an equivalent level of privacy protection, process the information only for the stated service and instructions, use appropriate security safeguards, and assist with deletion or rights requests where applicable. If we cannot maintain these protections, Beauty Assistant must remain disabled.

6. ForYou Processing, Logs and Facial Data

AR face guides and live camera preview are generally processed on your device. We do not collect or store raw AR face geometry for unauthenticated Beauty Assistant use.

When Beauty Assistant is enabled with consent, the sampled frames described in Section 1 are transmitted as visual context. ForYou's live proxy does not write microphone audio, camera frames, text, transcripts, AI responses or conversation history to its application database or persistent chat history. This content exists in server memory only as needed to relay the active session.

ForYou application logs record technical events such as a random session identifier, connection state, counts and error information. They do not intentionally include the content of audio, frames, prompts, transcripts or AI responses. Technical logs are retained only for the shortest period required by the hosting security and incident-response schedule and are then deleted or overwritten. They are not used for advertising or model training.

7. Other Sharing and Recipients

Depending on the feature, information may be disclosed to:

  • Google LLC — Gemini Developer API: the Beauty Assistant content and technical session data described above, only after consent, to generate responses.
  • Google LLC — Firebase Analytics: App interactions, approximate geography, installation or device identifiers and related app/device information when analytics collection is enabled. We do not intentionally send Beauty Assistant audio, camera frames, prompts, transcripts or responses to Firebase.
  • Google LLC — ARCore: an app-install-specific pseudonymous identifier, ARCore API usage, performance data and other diagnostics used to provide, measure and improve the App's augmented-reality face features. The App uses ARCore Augmented Faces and does not use ARCore Cloud Anchors or the Geospatial API.
  • ForYou hosting and infrastructure providers: encrypted traffic and technical operational data needed to operate and secure ForYou servers.
  • Support and communication providers: contact information and messages you send for support.
  • Authorities or transaction parties: information where required by law, necessary to protect rights and security, or involved in a corporate reorganization, subject to applicable safeguards.

We contractually or otherwise require service providers to process personal information only for the disclosed purpose, follow our instructions, maintain confidentiality and security, delete or return data when the service ends where applicable, and provide the same or an equivalent level of protection required by this Policy and applicable law.

We do not sell Beauty Assistant content. We do not share it with data brokers or advertising networks.

8. Analytics, Advertising and Tracking

The App uses Firebase Analytics to understand feature performance and reliability. Analytics begins only after the App Tracking Transparency status has been determined. If you authorize tracking, the App permits Firebase to process app-interaction data and an advertising or device identifier for attribution, advertising measurement and personalization across apps or websites. If you deny tracking, Firebase advertising storage, advertising user data and advertising personalization remain disabled, while non-tracking analytics may continue. You can use every App feature if you deny tracking. A response to the App Tracking Transparency prompt does not grant Beauty Assistant consent.

The App also includes Google's ARCore Augmented Faces SDK. Google states that ARCore always collects an app-install-specific pseudonymous identifier, API usage, performance data and other diagnostics for analytics, reliability and improvement. ARCore's disclosure is available in Google's App Store privacy guidance for ARCore. This ARCore telemetry is separate from Beauty Assistant content and does not include the sampled Beauty Assistant frames sent to Gemini.

Data gathered from camera, ARKit, facial mapping or photo APIs is not used for third-party advertising or unrelated marketing.

9. Retention and Deletion

  • ForYou Beauty Assistant content: audio, frames, prompts, transcripts, AI responses and conversation context are not stored in the ForYou application database or persistent chat history for the current unauthenticated live feature. They are released from the proxy when the live connection and related in-memory processing end.
  • On-device AI data: the consent choice remains until you withdraw it or remove the App. The current transcript and resumable session handle are held for the current App session; selecting "Withdraw AI Consent and Clear Session" clears them immediately. Deleting the App removes its locally stored settings.
  • Google Gemini: Google controls its service-side retention. For Paid Services, Google states that prompts and responses are not used to improve Google products. Abuse-monitoring logs may be retained for up to 55 days; Google Search grounding content is retained for 30 days; and isolated in-memory caching may last up to 24 hours. We submit deletion or rights requests to Google where available and legally required.
  • Firebase Analytics and ARCore telemetry: retained under the applicable Google service settings and retention schedules, then deleted, anonymized or aggregated. You can prevent Firebase advertising processing by declining the App Tracking Transparency request; required ARCore telemetry is processed as described in Google's ARCore privacy guidance.
  • ForYou technical logs: retained only for the shortest configured security and incident-response period, then deleted or overwritten. They do not intentionally contain Beauty Assistant audio, frames, prompts, transcripts or responses.
  • Support correspondence: retained while handling the request and afterward only as needed for follow-up, dispute resolution and legal obligations.

To request access or deletion, email foryou@appear.digital with the subject "Beauty Assistant Privacy Request". We will respond within 30 days, or within another period required by applicable law. Because the current live AI service is unauthenticated and ForYou does not persist its content, we may have no stored AI content that can be linked back to you. We will delete linked information we control and pass valid requests to relevant processors where applicable, unless retention is legally required.

10. International Transfers

Your information may be processed in countries outside your country of residence, including outside the European Economic Area. Where required, we use appropriate safeguards for international transfers.

11. Your Rights

Depending on your location, you may have rights to access, correct, delete, restrict, object to processing, port your data, withdraw consent and lodge a complaint with a supervisory authority.

To exercise rights, contact us at foryou@appear.digital. Withdrawal of consent does not affect processing that occurred before withdrawal.

12. Children's Privacy

The App is not directed to children under 13 or the equivalent minimum age in the relevant jurisdiction. We do not knowingly collect a child's personal information without any parental authorization required by law.

13. Security

We use technical and organizational measures designed to protect personal information, including encrypted transport, restricted service credentials, purpose-limited access and minimal content logging. No system is completely secure, and we cannot guarantee absolute security.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If a change materially affects Beauty Assistant data, recipients or purposes, we will update the in-App disclosure and request consent again before transmitting data under the new terms. The effective date above shows when this version took effect.
